İslam hukukundaki değişim olgusunun Fürû-i Fıkha yansıması: Devlete isyan suçu (bağy) örneği

Abstract

Hızla değişen dünya hayatında insanın bildiği şeylerle yetinmemesi gerekiyor. İslam hukuk ilminin de hayattaki değişmeyi yakalaması ve ortaya çıkan yeni durumlara cevap vermesi görevi bulunmaktadır. Bu da İslam hukuk ilminin hayatiyetini sağlayan ictihâdlar vesilesiyle olmaktadır. Çalışmamızda İslam hukukuna değişen hayat şartlarına cevap verebilme kabiliyeti sağlayan değişim olgusunun fürû-i fıkıh üzerindeki etkileri konu edilmiştir. Tezin birinci bölümünde ahkâmda değişime sebep olan etmenler, değişimi gerçekleştiren araçlar ve değişim etrafında oluşan görüşler incelenmeye çalışılmıştır. İkinci bölümde değişim olgusunu örneklemek bağlamında fürû-i fıkhın çeşitli alanlarından ictihâd örnekleri sunulmaya çalışılmıştır. Üçüncü bölümde ise çalışmanın odağında bulunan bağy konusu özelinde Hanefi fürû literatürünün incelenmesine ve konuya dair ahkâmın değişim ve gelişim sürecinin anlaşılmasına çalışılmıştır.

In the rapidly changing world, people should not be content themselves with what they know. The science of Islamic Law also has a duty to catch up with these changes and to respond to new problems that arise. This happens through ijtihads, which ensure the vitality of the science of Islamic Law. In this study, the effects of the change phenomenon, which provides the ability of Islamic Law to respond to changing life conditions, on Furūʿ al-Fiqh are discussed. In the first part of the thesis, the factors that cause the change in judgments, the arguments that make the change and the opinions formed around the change have been tried to be examined. In the second part, examples of ijtihads from the various fields of Furūʿ al-Fiqh have been tried to be presented within the context of exemplifying the phenomenon of change. In the third part, the Hanafi Furūʿ al-Fiqh literature has been examined within the context of the al-Bagy (Rebellion) subject and the change and development process of the judgments on the subject has been tried to be understood.
